Custody cases are emotional. No matter which way you slice it, you are likely facing less time with your children and are feeling anxiety, fear, and a growing resentment to the other parent.
The court will determine custody based on “the best interests of the child.” Louisiana Civil Code article 134 outlines 12 factors that the Court must weigh in determining the child’s best interest.
Notwithstanding, here are some common pitfalls to avoid to keep you in good graces with the Court when you have a pending custody matter:
1. Leave the children out of it. Kids sometimes get sad. And scared. And worried. Don’t involve them in your dispute with their other parent. Subtle remarks and insults do not go unnoticed. It adds to their stress and causes anxiety that can manifest into harmful behaviors.
2. Work in conjunction with the other parent for what it is in the best interests of the child. In cases where joint custody is awarded or the desired result, you must be able to communicate and effectively co-parent with the other parent. This may be easier said than done; however, there are resources you can take advantage of to do your best. Complete a parenting course, read books, subscribe to online parenting tools and forums… generally be civil and reasonable. A little flexibility never hurts either.
3. Lastly, behave. Don’t do drugs. Or abuse pills. If you have a problem seek help immediately. Use social media sparingly and wisely. Do not post about the case, the court, the judge, or your ex. Date with discretion. And, last but not least, follow court orders.
